The rules for using Siren. Most of them come down to this: listen for yourself, keep the sessions inside the app, and never use them while you need your full attention.
Welcome to Siren. These Terms and Conditions ("Terms") govern your access to and use of the Siren app for iPhone and Android (published on the App Store and Google Play as "Siren Mind"), the Siren website, and the related services we provide (together, the "Service"). The Service is operated by WAQYSTUDIOS LTD ("Siren", "we", "us" or "our"). By creating an account, or by downloading, accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
1. What Siren is
Siren is a listening app built around two things:
- Subliminal sessions: a growing library of long-form audio in which spoken affirmations are layered quietly beneath calm sound, organised by theme (such as manifestation, abundance, confidence, focus and success), streamed to your device and playable in the background while you sleep, study or walk. The app remembers where you left off in each session, lets you mark favourites, and keeps a streak and simple listening stats.
- Daily affirmations: one written affirmation a day, drawn from the themes you choose, with a history of the ones you have received and an optional morning reminder notification.
The library changes over time. We add, update and occasionally retire sessions and affirmations, and nothing in these Terms obliges us to keep any particular piece of content available.
2. Eligibility
You must be at least 16 years old to use the Service. By creating an account you confirm that you meet this requirement, that the email address you use is yours, and that the information you give us is accurate.
3. Your account
You sign in with an email address and password. Sign-in is provided by Firebase Authentication, and password resets are sent to your email address.
- Keep your password confidential. You are responsible for everything done through your account, and for signing out on devices you share.
- One account per person. Do not share your account or use someone else's.
- Tell us at support@waqystudios.com straight away if you think your account has been accessed without your permission.
- We may suspend or close accounts that break these Terms.
4. Using the Service
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app and to stream the sessions and read the affirmations for your own personal, non-commercial use, subject to these Terms. Sessions are streamed, so you need an internet connection to listen; your network provider's data charges are your responsibility. We may release updates to the app, and you may need to install them to keep using the Service.
You agree not to:
- Use the Service for any commercial purpose, including playing sessions for an audience, in a business, or as part of any product or service.
- Download, record, capture, rip, extract, copy, store outside the app, redistribute, publicly perform, broadcast, sell, rent or otherwise make available any session, artwork or affirmation, in whole or in part.
- Remix, alter, translate, or create derivative works from any of our content.
- Circumvent, disable or interfere with any access control, streaming protection or other security feature of the Service.
- Access our servers or media other than through the app, or use bots, scrapers or other automated tools to interact with the Service.
- Reverse-engineer, decompile or attempt to extract the source code of the app, except where the law expressly allows it.
- Upload or transmit malicious code, or use the Service to harm, harass or impersonate anyone.
- Use the Service in breach of any applicable law or regulation.
5. Wellbeing and safety
Never listen to a session while driving, operating machinery, or doing anything that needs your full attention. Many sessions are designed for sleep and deep relaxation, and they may make you drowsy.
Siren is a relaxation and mindset practice. It is provided for general wellbeing and enjoyment only.
- Sessions and affirmations are not medical, psychological or therapeutic advice, diagnosis or treatment, and are not a substitute for care from a qualified professional. If you have, or think you may have, a physical or mental health condition, talk to a professional before relying on any wellbeing practice, including this one.
- We make no promises about outcomes. Everyone responds differently, and we do not guarantee that any session or affirmation will produce a particular result.
- Listen at a comfortable volume, and stop listening if you feel unwell or uncomfortable.
- The Service is not an emergency or crisis service. If you are in crisis or thinking about harming yourself, contact your local emergency number or a crisis line immediately.
6. Content and intellectual property
The sessions, affirmations, artwork, names, logos, design and code that make up the Service are owned by us or licensed to us, and are protected by copyright, trade mark and other intellectual property laws. Some sessions are produced by independent creators and are included in the library with their permission; their rights are reserved in the same way. Except for the personal licence in section 4, nothing in these Terms gives you any right, title or interest in the Service or its content.
If you send us feedback or suggestions, you agree that we may use them to improve the Service without any obligation to you.
7. Your information
Using the Service creates data about you: the names you enter, your listening progress, favourites and daily totals, your affirmation themes and history, and, if you turn the morning reminder on, a notification token for your device. You give us the right to use that data to operate and improve the Service, as described in our Privacy Policy. Any name you enter must be your own or one you are entitled to use, and must not be offensive or misleading.
8. Notifications
The morning reminder is optional and off by default. If you turn it on and allow notifications on your phone, we will send one notification a day with your affirmation. Delivery depends on your device, its settings and your network, so a notification may arrive late or not at all; the affirmation itself is always available in the app. You can turn the reminder off at any time in the app or in your phone's settings.
9. Fees
Siren is currently free to use. If we introduce paid features or subscriptions in the future, we will show you the price and any renewal terms before you pay, and any purchase will be handled by the Apple App Store or Google Play under their own terms. We will not charge you for anything without your agreement.
10. Availability and changes to the Service
We aim to keep the Service available, but we do not promise that it will be uninterrupted, error-free or available at any particular time. We may need to suspend it for maintenance or updates. We may change the Service, add or remove features, and add, update or retire sessions and affirmations at any time. If we decide to discontinue the Service altogether, we will give you reasonable notice in the app or on this website.
11. Ending your account
- By you. You can delete your account from the app (Profile → Account → Delete account). A 30-day grace period follows, during which you can change your mind and cancel from the same place. When the period ends your sign-in and your data are permanently deleted, as described in the Privacy Policy. You can also simply stop using the Service.
- By us. We may suspend or end your access, with or without notice, if you breach these Terms, if we are required to by law, or if we discontinue the Service.
- When your account ends, the licence in section 4 ends with it. Sections 5, 6, 12, 13, 14 and 16 continue to apply.
12. Third-party services
The Service relies on services provided by others: Google Firebase for sign-in and notifications, Amazon Web Services for hosting session audio and artwork, and the Apple App Store or Google Play for distributing the app. Your use of those services is subject to their own terms and policies, and we are not responsible for them.
13. Disclaimer
To the fullest extent permitted by law, the Service and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. In particular, and as set out in section 5, we make no warranty about any effect a session or affirmation may have.
14. Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. If you are a consumer, nothing in these Terms affects your statutory rights.
Subject to that, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of data, profits or goodwill, arising out of or in connection with your use of, or inability to use, the Service, even if we have been advised of the possibility of such loss. Our total liability to you for all claims arising out of or relating to the Service or these Terms shall not exceed the amount you have paid us in the 12 months before the claim, or £10, whichever is greater.
15. Changes to these Terms
We may update these Terms from time to time, for example when we add features. The date at the top of this page shows the latest revision. If a change is material, we will tell you in the app or on this website before it takes effect. If you keep using the Service after the change takes effect, you accept the updated Terms; if you do not agree, please stop using the Service and delete your account.
16. Governing law
These Terms are governed by the laws of England and Wales, and any dispute arising out of or in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you live in another country as a consumer, you keep the benefit of any mandatory protections of the law of that country, and you may bring proceedings in its courts.
